Terms of Service

These Terms of Service ("Terms") govern your access to and use of SalesFury (the "Service"), operated by SalesFury ("we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Accounts & Eligibility

You must be at least 18 years old and able to form a binding contract to use SalesFury. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it updated. Notify us immediately of any unauthorized use of your account.

2. Organizations & Team Members

SalesFury is a multi-tenant platform. When you create an organization, you become its administrator and are responsible for the conduct of all users you invite. Administrators may add, remove, and manage the permissions of team members. The organization owner is responsible for all activity and any fees incurred within their workspace.

3. Subscriptions, Plans & Billing

• Paid Plans: All plans are paid subscriptions billed on a recurring monthly basis until cancelled. Solo Killer is billed at a flat monthly rate; Wolf Pack is billed per seat; War Machine is priced by agreement.
• Renewals: Subscriptions automatically renew unless cancelled before the end of the current billing period.
• Changes: We may change pricing with reasonable prior notice. Continued use after a price change constitutes acceptance.
• Taxes: Fees are exclusive of applicable taxes, which you are responsible for paying.

4. Your Content & Data

You retain all rights to the contacts, deals, messages, and other data you upload to SalesFury ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to operate and improve the Service. You are solely responsible for the accuracy, legality, and appropriateness of Your Content and for having all necessary rights and consents to use it.

5. Acceptable Use & Communications Compliance

You agree to use the Service in compliance with all applicable laws, including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and any applicable state laws. This includes:

• Obtaining required consent before sending marketing emails, SMS messages, or making calls.
• Honoring opt-out, unsubscribe, and Do-Not-Call requests promptly.
• Including accurate sender identification and a valid physical postal address in commercial email.
• Respecting calling-hour restrictions and time-zone limitations.

Your full obligations are described in our Acceptable Use Policy and SMS Terms, which are incorporated into these Terms. SalesFury provides compliance tools, but you remain solely responsible for your communications.

6. Third-Party Services

The Service may integrate with third-party providers (such as Twilio for SMS and voice). Your use of those services is subject to their respective terms. We are not responsible for third-party services and disclaim liability arising from them.

7. Intellectual Property

The Service, including its software, design, trademarks, and content (excluding Your Content), is owned by SalesFury and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

8. Prohibited Conduct

You may not: (a) use the Service for unlawful, harassing, or fraudulent purposes; (b) send spam or unsolicited communications in violation of law; (c) reverse-engineer, scrape, or attempt to gain unauthorized access to the Service; (d) resell or sublicense the Service without authorization; or (e) interfere with the integrity or performance of the Service.

9. Suspension & Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, create risk or legal exposure for us, or engage in abusive or non-compliant communications. You may cancel your account at any time. Upon termination, your right to use the Service ends immediately. We may retain or delete Your Content as described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALESFURY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless SalesFury from any claims, damages, or expenses arising from your use of the Service, Your Content, your communications, or your violation of these Terms or applicable law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms with a new effective date. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which SalesFury is established, without regard to conflict-of-laws principles.
